1. Scope
These Terms and Conditions apply to all contracts for the sale and provision of eSIM data plans between Simtasy OÜ (sim.do) and the customer.
Deviating conditions of the customer will not be recognized unless we expressly agree to their validity in writing.

3. Contract Conclusion
1. The presentation of products on our website does not constitute a legally binding offer, but an invitation to place an order.
2. By clicking the "Buy" or "Checkout" button, you place a binding order for the goods contained in the shopping cart.
3. The contract is concluded only upon our acceptance of your order, which we confirm to you by email (order confirmation).
4. The purchase contract is concluded with the order confirmation.
4. Service (eSIM Activation)
We deliver eSIM data plans in digital form. After successful payment, you will receive the eSIM activation data (QR code, activation code) by email.
Activation is done by scanning the QR code or manually entering the activation code on a compatible device. The usage period and data volume depend on the selected plan.
Important : Using an eSIM requires an eSIM-capable device. You can check the compatibility of your device on our website before purchase.
5. Prices and Payment
All displayed prices are final prices including applicable value-added tax (where applicable). There are no additional delivery or shipping costs, as delivery is exclusively digital.
Payment is made through our payment service provider Stripe. Accepted payment methods are credit card (Visa, Mastercard, American Express) and other payment methods supported by Stripe.
The purchase price is due upon conclusion of the contract and must be paid immediately.
6. Withdrawal and Refund
Right of Withdrawal
As a consumer, you generally have a 14-day right of withdrawal according to the EU Consumer Rights Directive (2011/83/EU) and the Estonian Consumer Protection Act (Tarbijakaitseseadus).
Expiry of Withdrawal Right for Digital Content
The right of withdrawal expires for digital content (eSIM activation data) if we have started the execution of the contract after you have expressly agreed that we may begin execution before the expiry of the withdrawal period, and you have confirmed your knowledge that you lose your right of withdrawal by giving your consent to the start of execution (Art. 16(m) Consumer Rights Directive 2011/83/EU).

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., by email) of your decision to withdraw from this contract.

7. Liability
Our liability is governed by the Estonian Law of Obligations Act (Võlaõigusseadus). We are liable for damages caused by intentional or negligent breach of duty.
To the extent permitted by law, our liability is limited to foreseeable, contract-typical damages. This does not apply to damages arising from injury to life, body, or health.
We assume no liability for network coverage, connection quality, or data speeds, as these depend on local mobile network operators.
8. Jurisdiction and Applicable Law
All legal relationships between us and the customer are governed by Estonian law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country where the consumer has their habitual residence remain unaffected pursuant to Art. 6(2) of Regulation (EC) No 593/2008 (Rome I).
The place of jurisdiction is Tallinn, Estonia (Harju Maakohus). For consumers, the statutory provisions on jurisdiction apply in accordance with Regulation (EU) No 1215/2012 (Brussels Ia).
9. Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
